Terms and Conditions of Sale

Article 1 — Purpose

These Terms and Conditions govern the services offered by Sophie Benardeau-Short, trading as Culturelinks ("Culturelinks"): Diagnostic Pack, intercultural, language and transition coaching programmes, for individuals and companies.

Article 2 — Services and pricing

Services and indicative pricing are detailed on the Companies and Individuals pages of the site. Each corporate programme is custom-built following the Diagnostic Pack; a quote is provided before any commitment. Prices are shown exclusive of tax (HT), as Culturelinks is not subject to VAT (article 293 B of the French Tax Code).

Article 3 — The Diagnostic Pack

The Diagnostic Pack (companies) is billed separately (€350 excl. tax for the employee alone / €450 excl. tax for the employee plus spouse/partner). The Discovery Session (individuals) is billed separately (€90 individual / €150 as a couple). In both cases, the amount is fully deducted from the chosen programme if it is signed within 30 days of the diagnostic being delivered.

Article 4 — Payment terms

Corporate clients: payment is made according to the following schedule: 30% on order, 40% at the midpoint of the programme, 30% at completion. Each invoice is payable within 30 days of its issue date, in accordance with the statutory ceiling set by the French Commercial Code (art. L441-10).

Individual clients: payment is due in full on receipt of invoice, unless other terms are agreed in writing (e.g. instalment payment for a longer programme).

Late payment penalties (corporate clients): in accordance with article L441-10 of the French Commercial Code, any late payment results in penalties calculated at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points, as well as a fixed recovery fee of €40, with no prior notice required.

Article 5 — Cancellation and rescheduling

Any session must be cancelled or rescheduled at least 24 business hours before the scheduled time, by email or text message. After this deadline, the session is considered due and will be invoiced in full, whether or not it took place.

Article 6 — Right of withdrawal (individuals)

In accordance with articles L221-18 et seq. of the French Consumer Code, individual clients have 14 days from the date the contract is signed to exercise their right of withdrawal, without having to give a reason or pay any penalty.

A standard withdrawal form is provided with the contract or on request.

If the client wishes the service to begin before this 14-day period has elapsed, they must make an express written request (by email or by signing a dedicated clause in the contract). In that case, the client loses their right of withdrawal once the service has been fully performed before the end of the 14-day period; if the service has only been partially performed, the client remains liable for an amount corresponding to the services already provided.

Article 7 — Amicable dispute resolution — Consumer mediation

In accordance with articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes:

Where a consumer has sent a written complaint to the professional and has not received satisfaction or a response within two months, they may submit their complaint free of charge to the consumer mediator. The mediator must be notified within a maximum of one year from the date of the initial complaint.

Failing an amicable resolution, the competent courts shall be those of Paris.

Data controller

The controller for data collected on culturelinks.fr is Sophie Benardeau-Short, sole trader trading as Culturelinks, SIRET 880 597 273 00023, contact@culturelinks.fr.

● Contact details submitted via the contact form or by email/phone

● Information gathered during coaching or training sessions

● Answers to the CultureConnector© profiling questionnaire, entered directly by the client on Argonaut's platform (see below)

Purposes and legal bases

● Responding to enquiries and following up on support provided — performance of pre-contractual steps and of the contract

● Carrying out the diagnostic and building the recommended programme — performance of the contract

● Issuing invoices — legal and accounting obligation

Data recipients

Data is processed by Sophie Benardeau-Short and, where applicable, shared with the following processors, strictly to the extent necessary for the service:

● Hostinger International Limited (website hosting) — GDPR processor, data hosted within the European Union (Cyprus)

● Superindep (invoicing management) — GDPR processor

Answers to the CultureConnector© profiling questionnaire are entered directly by the client on Argonaut's platform, the tool's publisher, and are not transmitted through Culturelinks. This processing is governed by Argonaut's own privacy policy, available on its website, which clients are invited to refer to before entering their answers.

Confidentiality towards corporate clients

Where a programme is funded by a company, only a one-page summary sheet is shared with HR teams. No detailed personal data about the employee (session content, individual diagnostic results) is shared with the company beyond this summary.

Data retention

Client data is retained for the duration of the business relationship, plus 5 years for accounting and legal purposes (article L123-22 of the French Commercial Code). Data from a simple enquiry via the contact form (with no resulting business relationship) is retained for a maximum of 3 years from the last contact.

Your rights

Under the GDPR, you have the right to access, rectify, erase, restrict and port your data, as well as the right to set guidelines on what happens to your data after your death. You can exercise these rights by writing to contact@culturelinks.fr.

You also have the right to lodge a complaint with the French data protection authority, the Commission Nationale de l'Informatique et des Libertés (CNIL) — cnil.fr — if you believe your rights are not being respected.

The site's contact form allows you to send us your details and message; this information is processed as described under "Data collected" above and is not used for any other purpose.
